1. Agreement to Terms

These Terms & Conditions ("Terms") govern your use of the website, software, and services provided by RABRH LLC ("Company") under the product name RABRP (Realty Automation & Brokerage Resource Platform).

By creating an account, publishing a customer website, or accessing RABRP, you agree to be bound by these Terms and our Privacy Policy.

2. Customer Accounts & Workspace Use

RABRP provides multi-tenant website hosting, seller lead capture, and CRM software for licensed real estate agents, brokerages, home inspectors, and service professionals.

• You are responsible for maintaining the confidentiality of your workspace credentials.
• You agree to provide accurate business, licensing, and professional details.
• You agree not to use the platform for fraudulent, unauthorized, or illegal activities.

3. Real Estate Regulatory & Compliance Responsibility

Licensed real estate professionals using RABRP are solely responsible for ensuring their customer websites comply with state real estate commission rules (such as GREC rules in Georgia), including displaying required sponsoring brokerage names, license numbers, office phone numbers, and equal housing disclosures.

4. FMLS & Property Search Status

Demonstration properties displayed on public preview pages represent sample data. Live MLS IDX property search is offered to eligible agent and brokerage accounts following official FMLS approval and completion of sponsoring broker requirements.

5. Developer API Gateway & Acceptable Use

RABRP provides programmatic API access (including /api/v1/property/lookup and related endpoints) to county GIS, tax digest, parcel boundary, and property assessment data.

• API Key Security: You are strictly responsible for maintaining the confidentiality of your API keys (e.g., x-api-key, Authorization: Bearer). You must not embed secret API keys in public client-side repositories or unauthenticated web browsers.
• Rate Limits & Quotas: API usage is throttled according to your subscribed tier (Sandbox: 50 requests; Starter: 10,000 requests/month; Pro: 50,000 requests/month). Automated attempts to bypass rate limits or evade Cloudflare Turnstile challenges are strictly prohibited and will result in immediate API key revocation.
• Prohibited Uses: You agree not to use the API or property data for unlawful harassment, stalking, discriminatory housing practices in violation of the Fair Housing Act (42 U.S.C. § 3601 et seq.), or creating automated spam registries.

6. Public Records & Government Data Disclaimer (O.C.G.A. § 50-18-70)

Property assessment values, parcel geometries, deed transfer references, and ownership records are sourced directly from county tax commissioner, board of tax assessors, and ArcGIS enterprise services pursuant to the Georgia Open Records Act (O.C.G.A. § 50-18-70 et seq.).

Informational Use Only: Data returned by the API is compiled for analytical, underwriting, and research purposes. It does not constitute a certified appraisal, a legal boundary survey, or a title insurance commitment. Users must independently verify deed books and tax receipts with county authorities prior to closing transactions.

7. API Subscriptions, Billing & Cancellations

Paid API subscription tiers (Starter and Pro) are billed on a recurring monthly cycle via Stripe Billing.

You may manage or cancel your subscription at any time through the self-serve Stripe Customer Billing Portal. Cancellations take effect at the end of the current paid billing period, with access maintained until that date.

8. Stripe Connect & Service Provider Payments

Eligible service professionals (such as home inspectors) may optionally connect a Stripe account to accept appointment bookings and payments.

Payment processing, payouts, fees, refunds, and disputes are governed by Stripe's Connected Account Agreement. RABRH LLC is not liable for payment disputes between service providers and their clients.

9. Limitation of Liability

To the maximum extent permitted by law, RABRH LLC shall not be liable for any indirect, incidental, or consequential damages resulting from platform service interruptions, upstream county GIS server timeouts (HTTP 504), upstream county service unavailabilities (HTTP 502), or loss of data.
